Hawaiireporter notes that the OMI v. Gates case has settled, and court pleadings (stipulation to dismiss, Order of Dismissal, and Final Judgment ) prove it.

The settlement was likely based on two reasons:  1) the Winter v. NRDC decision from the U.S. Supreme Court and 2) the National Marine Fisheries Service issuance of an incidental take permit.
